Only Appeal Court Judgment Can Displace Ruling Of Justice Omotosho – Abraham

The Abia State PDP Chairman, Amah Abraham, has kicked against the judgement of Justice A.L Akintola, saying that the judgment of Justice James Omotosho of the Federal High Court, Abuja, supersedes that of the Oyo State High Court.

Recall that the Federal High Court in Abuja, presided over by Justice Omotosho, had restrained the Independent National Electoral Commission (INEC) from recognising the outcome of the forthcoming 2025 National Convention of the PDP.

However, NEWSNGR reports that the Oyo State High Court, on Tuesday, granted the PDP approval to proceed with its elective national convention scheduled for November 15–16, 2025, in Ibadan, the state capital.

Delivering the ruling, Justice Akintola issued an interim order allowing the party to continue its convention plans without obstruction and directed INEC to monitor the exercise.

Speaking during an interview on Arise Television on Wednesday, Abraham maintained that only a Court of Appeal judgement can override the decision of Justice Omotosho.

He stated that thousands of PDP faithful, including himself, have subscribed to the judgment stopping the convention.

“I am aware that there are moves for appeal. It is only an appeal that can displace that judgment. I don’t think that any judgment is good enough to displace the federal capital judgment delivered by Justice Omotosho.” he said.

Amah said he and other members who believe in justice and due process will not take part in the party’s planned national convention unless all pending state congresses are properly concluded.

He maintained that his position was not about belonging to any faction but about insisting that the right procedures be followed to ensure fairness and representation within the party.

“In every political conversation or political structure, there are diverse opinions and views, and those opinions and views do not necessarily amount to a faction.

“I believe that in the PDP conversation table, we have people with different views, and I also believe that those views do not necessarily amount to a faction.

“I stand with those who believe that justice demands that before you go for a national convention, all the delegates that need to have emerged from the various states and the geopolitical zone must have been seen to emerge, and their names forwarded to the national,” Amah said.

He criticized moves to go ahead with the convention despite unresolved issues in states such as Anambra, Ebonyi, and across the Southeast, saying it would amount to disenfranchising members from those areas.

Abraham also dismissed allegations that he and others pushing for due process were being sponsored by the opposition to destabilize the PDP.

He noted that they are simply party loyalists who believe that the PDP must be guided by the rule of law.
